For a property owned by a non-resident, the Spanish Tax Agency states that the purchaser must generally retain and pay 3% of the agreed consideration using Form 211. This is a payment on account of the non-resident seller’s tax, not automatically the final tax bill or an agency fee. Ask an independent adviser to confirm the seller’s residence, filing and refund or payment position for the specific transaction.

Begin by collecting accurate information about the property and asking your independent Spanish lawyer which current documents and checks apply to your sale. Your lawyer may ask you to assemble identity and tax-number details for each owner; the title deed and current Land Registry information; IBI and cadastral information; mortgage or charge details; relevant planning, occupancy or renovation records; and any lease, booking or inventory information if the home is occupied or contents are included.

For a home governed by the Horizontal Property Law, the seller should also ask about the community-debt certificate used at the public deed. Article 9 of the consolidated law states that the transferor provides a certificate matching the declaration of community debts unless the purchaser expressly releases the seller from that obligation. Separately, Royal Decree 390/2021 addresses energy-certificate and label information for sale advertising and contracts. An independent lawyer or competent technician should confirm how the current rules and exemptions apply to the property.
